Regulations for orders via www.sklep.szkieletowka.pl

Below are our General Terms and Conditions, constituting all services rendered at sklep.szkieletowka.pl. Using www.sklep.szkieletowka.pl we offer each customer an individual shopping and service process with services tailored to his interests and needs. At www.sklep.szkieletowka.pl we sell our own production articles.

Szkieletówka.pl Mariusz Mojsa production covers all products offered on the website www.sklep.szkieletowka.pl and applies only to selected individual customer orders.

1. Conclusion of the contract and delivery of products

1.1 At www.sklep.szkieletowka.pl an agreement containing in Polish or English. For contracts for ordered products, the side of deal is Szkieletówka.pl Mariusz Mojsa

1.2 Purchase can be made by creating an account, registering, or at the time of purchase by providing your data, when comparing the described order.

1.3 Clicking the “buy and pay” button will place a binding order for the products in the basket. Placing an order confirmed by post all after sending your order. Conclusion of a binding contract with the entire amount paid by you to our account and receipt of your order. Please note that the products ordered by you produced and available are subject to your payment of their full prices and delivery costs, or unless personal collection is selected .

1.5 We fulfill orders in Poland and Great Britain. If the delivery date is used on business days, it should be understood as all days from Monday to Friday inclusive, with the exception of public holidays.

1.6 If additional options are selected on the summary page, they form part of the contractual terms of the contract. The amount of the additional payment will be given before the conclusion of the contract and sent by e-mail. Therefore, we ask you to withhold payment until you receive this information. 

2. Prices, shipping costs and express delivery

2.1 The prices offered at the time of placing the order shall apply. The prices offered are final prices, i.e. they also include VAT in the currently applicable amount. Until full payment of the sale price, the product remains our property.

2.2 Shipping costs, except for personal collection, are paid by the Purchaser.

2.3 We offer express delivery for some orders. During the ordering process you will receive information whether express shipping is offered for the order and how much it costs. The product, if you choose the express shipping option, will be delivered within 14 business days at the latest. If this delivery period is exceeded, you will of course receive a refund of the shipping costs.

3. Payments

3.1 We offer the following payment methods: Paypal and bank transfer. We reserve the right not to offer certain types of payments and offer others for each order. Please note that we only accept payments from bank accounts within the European Union (EU) and the United Kingdom. You bear all financial transaction costs.

3.2 You hereby agree to receive information on credentials only in electronic form.

4. Discount coupons and their use

4.1 Discount coupons are vouchers that cannot be purchased, but are issued only as part of advertising campaigns, and have a specific validity period.

 

4.2 Discount coupons can be used only for a specified time and only as part of one order. Some products may be excluded from the promotion. Please note that discount coupons may be associated with a minimum purchase value.

4.3 The value of the product must be no less than the amount on the discount coupon. Any difference in the case of a higher value of the product can be offset by payment made in one of the ways offered. The rebate coupon cannot be paid in cash, it is not interest-bearing either. A rebate coupon cannot be returned once the product has been fully or partially returned.

 

4.4 Discount vouchers can only be used before the ordering process has been completed. Subsequent use is not possible. Discount coupons cannot be transferred to third parties. In the absence of other arrangements, several discount coupons cannot be combined.

4.5 If you use a discount coupon during your purchases, we reserve the right to charge the original price of the products that you keep, if – due to your withdrawal from the contract – the total value of the order falls below the value of the discount coupon.

5. The statutory right to withdraw from the contract for the purchase of products at Szkieletówka.pl

If you purchase products Szkieletówka.pl Mariusz Mojsa, you have the statutory right to withdraw from the contract: First of all, we would like to inform you that if you send back the products, you can use the attached return form available for printing on your customer account. If you do not have a printer at your disposal, have problems downloading the form or need a new return form, you can send an application by e-mail to biuro@szkieletowka.pl. Please include all your purchase details, such as your name, date of purchase, email and contact number. Please also help us to avoid additional costs and send returns always after prior agreement with the Seller. Until the item reaches the Seller, all defects and damage resulting from transport, or improper protection of the product, are the responsibility of the Buyer. Only the product with no signs of use can be returned in its original condition. The right to withdraw from the contract does not apply to products manufactured on individual orders. If you pay the full amount of the order for such a product, you agree that you cannot cancel the order or return it.

Information about the right to withdraw from the contract You have the right to withdraw from the contract within fourteen days without giving any reason. The deadline to withdraw from the contract runs from the day on which you or a third party indicated by you who is not a carrier has entered into possession of the product. In order to exercise your right of withdrawal, you must notify Szkieletówka.pl of your decision in this matter Mariusz Mojsa Kolonia Oziabły 31, 16-050 Michałowo e-mail: biuro@szkieletowka.pl by means of an unambiguous declaration of will (e.g. by letter or email). You can use the attached model withdrawal form. However, there is no such obligation. You can fill out and send us the withdrawal form or draw up and send any other declaration of intent, also electronically, using the contact form on our website. If you use this option, we will send you confirmation of receipt of your statement immediately (e.g. by e-mail). In order to declair the right to withdraw from the contract, it is sufficient to send a notification about declair this right before the deadline to withdraw from the contract.

Consequences of withdrawal from the contract In the event of your withdrawal from the contract, we are obliged to immediately, but no later than within fourteen days of receipt of your notification of withdrawal from the contract, return all payments received from you, including delivery costs (except for additional costs) , which may arise in connection with your choice of a delivery method other than the cheapest usual delivery method we offer). We use the same means of payment that you used during the original transaction to return your payment, unless we explicitly agree with another form of payment with you. Under no circumstances will we charge you any fees. However, we may refuse to refund the payment received from you until we receive the return of the product, or if it turns out that the product has been damaged or returned in a form other than its original form. You, in turn, are obliged to send us the product back or hand it over immediately, but not later than fourteen days from the day on which you informed us about the withdrawal from the contract and receiving feedback from us. The deadline is met if the product is shipped within fourteen days of this. You will bear the costs of return delivery. You are responsible for reducing the value of things as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of things.

NOTE: The exclusion of the right to withdraw from the contract in accordance with Art. 38. Act of 30 May 2014 on consumer rights: The right to withdraw from a contract concluded off-premises or at a distance is not entitled to the consumer in relation to contracts:

– in which the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or serving to satisfy his individual needs.

– for the provision of services if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after fulfilling the service by the entrepreneur, he will lose the right to withdraw from the contract. (e.g. for additional services such as assembly, painting, etc.) 

6. Payment returns

All refunds are made automatically to the account you use to pay. In the event of payment by bank transfer, the payments will be returned to the account from which the transfer was made. If you pay by PayPal, the refund will be made to the linked PayPal account.

7. Statutory liability for product defects

7.1 We are committed to providing you with products free from defects.

7.2 In the event of any defects in products ordered via www.szkieletowka.pl, we bear statutory liability under the warranty for defects, resulting from art. 556 and subsequent of the Act of April 23, 1964 – Civil Code (Journal of Laws 2016.380, as amended).

8. Complaints

8.1 All complaints regarding products purchased in our store should be submitted via the complaint form, unless otherwise stated above. Inquiries related to the course of the implementation of your order should be submitted via email to the address biuro@szkieletowka.pl, by phone or electronically (via the contact form). 

8.2 In some cases, we may ask you to send us photos of products subject to complaint.

8.3 Your complaint will be considered by us within 14 days from the date of receipt of a complete complaint. We will notify you immediately of any shortcomings in the complaint. Along with such a notification you will be sent information on how to fill the gaps in the complaint.

8.4 We would like to inform you that you have the opportunity to use extrajudicial methods of dealing with complaints and redress in accordance with the procedure of Internet Dispute Resolution developed by the European Commission available on the website: https://webgate.ec.europa.eu/odr/main/?event=main.home.show

8.5 All court disputes will be resolved on the basis of the law in force in Poland.

9. Warranty conditions

9.1 The Guarantor ensures efficient operation of the Subject of Sale for a period of 24 (twenty-four) months from the date of its issue or completion of assembly, provided that it was commissioned by the Guarantor by the Eligible from the guarantee.

9.2 The Guarantor undertakes to remove physical defects free of charge, in the event of inability to repair, to replace the Subject of sale for one free of defects, and in the event of inability to repair or replace the Subject of sale, to refund the price paid, if the defects become apparent within:

– 60 (sixty) months for the construction of residential houses, carried out on the basis of individual projects, and which are founded on foundations,

– 24 (twenty-four) months for: gazebos, summer houses, tool houses, children’s houses, swings, woodsheds, other wood products made by the Guarantor,

from the date of its issue or delivery of the Item free from defects.

9.3 The holder of the warranty is entitled to demand the replacement of the Subject of sale or its element, if at least 4 (four) repairs have been made within the Warranty period, and the Subject of sale is still defective. 

9.4 The person entitled under the warranty may report defects of the Subject of sale to the Guarantor in person, in writing to the following address: Oziabły Kolonia 31, 16-050 Michałowo or by e-mail to the address: biuro@szkieletowka.pl.

9.5 The warranty period is extended by the time during which, as a result of a defect in the Subject of sale covered by the Warranty and as a result of the need to remove it, the use of the Subject of sale or its elements was impossible or significantly impeded. The extension of the Warranty period applies only to those items of equipment that were impossible or difficult to use.

9.6 Liability under the Guarantee covers only defects arising from causes inherent in the Subject of sale.

9.7 In the event of defects, the Eligible Person from the warranty shall deliver the Subject of sale at the expense of the Guarantor to the place of purchase of the Subject of sale or to the place where the item was released when the Guarantee was granted, unless the circumstances indicate that the defect should be removed in the place where the item was at the time the defect was revealed. The Guarantor undertakes to perform the obligations arising from this Guarantee within 30 (thirty) days from the date on which the Warranty Authorized person notifies the Guarantor of the defect.

9.8 In the event of sending the Subject of sale to the Guarantor for the purpose of demanding the rights arising from the Guarantee, the risk of accidental loss or damage of the Subject of sale from the date of its issue to the Beneficiary from the warranty until the day of its receipt by the Authorized shall be borne by the Guarantor.

9.9 Shipment of the returned Subject of Sale or its components resulting from the Guarantee may take place only after the complaint has been accepted by the Guarantor and after prior agreement of this return with the Guarantor.

9.10 The warranty does not cover defects resulting from improper use, improper maintenance, improper assembly (if not carried out by the Guarantor), natural wood properties (e.g. healthy knots and natural wood cracks occurring during the use of wood, damage caused as a result of natural wear, caused by the influence of changing weather conditions in which the Subject of the contract is used. 

10. Changes to the regulations

10.1 Szkieletówka.pl is entitled to amend the Regulations and this change becomes effective on the date indicated by Szkieletówka.pl. The date of change may not be shorter than 15 days from the moment the amended Regulations are available in the Store.

10.2 The User, when logging in to the Store for the first time, counting from the entry into force of the changes, will be notified of such changes and of the possibility of their acceptance. The acceptance of changes is also considered to be automatic renewal of the Offer ordered by the User, even if it took place without logging in to the Store and the first activity performed by the User in the Store, after the entry into force of the changes if the User remains logged in at that time. In the absence of acceptance of changes, the User in order to terminate the contract should immediately notify Szkieletówka.pl using the email address: biuro@szkieletowka.pl

12.1 These regulations can be found at www.sklep.szkieletowka.pl. In addition, you can print or save this document using the usual functions of your web browser (most often: File -> Save As). You can also download this document in PDF format and archive it. In order to open a PDF file you need a free Adobe Reader program (available at www.adobe.pl) or another similar program that opens PDF files.

12.2 You can archive your order data simply by downloading the regulations and saving the order summary information on the last page of your order when placing it in the online store using the “Save as” function in your web browser; You can also wait for the order confirmation, which we will send you by e-mail after completing the order process to the address provided by you. This order confirmation email contains all the relevant details of your order, and it is possible to print it easily and save it using an e-mail program.

12.3 The offers available at www.sklep.szkieletowka.pl may be used by persons at least 18 years old.

12.4 Each customer is entitled to have up to one customer account at sklep.szkieletowka.pl at the same time. We reserve the right to delete multiple registrations.
